Welcome to Bandley 3. These Terms of Service ("Terms") govern your access to and use of the Bandley 3 website at www.bandley3.com (the "Site"), including any purchases, content, features, and services offered through the Site (collectively, the "Services"). Bandley 3 is operated by Bandley 3, LLC ("Bandley 3," "we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site. We reserve the right to update these Terms at any time. Material changes will be communicated via email or a notice on the Site. Your continued use of the Site after any update constitutes your acceptance of the revised Terms.
1. About Bandley 3
Bandley 3 is a curated art and design studio creating original artwork for the modern creative class. Our catalog includes original photography, digitally composed works, and pieces created with the assistance of generative artificial intelligence tools — each thoughtfully conceived, carefully edited, and produced to gallery-quality standards. For more detail on our creative process, please see Section 9 ("Artwork & Creative Process") below.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Site or make a purchase. By using the Site, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
3. Accounts
Certain features of the Site may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@bandley3.com if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate accounts at our discretion if we believe there has been a violation of these Terms.
4. Products & Orders
All products offered through the Site are made to order. When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including product availability, pricing errors, or suspected fraud. If we are unable to fulfill your order, we will notify you and issue a full refund to your original payment method.
Prices are listed in U.S. dollars and are subject to change without notice. We make every effort to display accurate pricing, but errors may occasionally occur. If an error affects your order, we will contact you before processing.

5. Payment
We accept the payment methods displayed at checkout. All payments are processed securely through Shopify Payments and/or third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and that the information is accurate. We do not store your payment card details on our servers.
6. Shipping
Shipping times and costs are estimated at checkout. Because our products are made to order, please allow additional processing time before shipment. We are not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control. Risk of loss and title for items pass to you upon delivery to the carrier.
7. Intellectual Property
All content on the Site — including artwork, images, text, logos, the Bandley 3 name and brand identity, graphic designs, and any other materials (collectively, "Content") — is owned by or licensed to Bandley 3 and is protected by copyright, trademark, and other applicable intellectual property laws.
When you purchase artwork from Bandley 3, you receive a physical product for personal, non-commercial display. You do not acquire any intellectual property rights in the underlying artwork. You may not reproduce, distribute, modify, publicly display (other than in your personal space), create derivative works from, or commercially exploit any Content without our prior written consent.
The Bandley 3 name, logo, and all related marks are trademarks of Bandley 3, LLC. Unauthorized use of any trademark is strictly prohibited.
8. User Conduct
You agree not to use the Site in any manner that: (a) violates any applicable law, regulation, or these Terms; (b) infringes the rights of any third party; (c) is fraudulent, deceptive, or misleading; (d) involves the distribution of malware, spam, or other harmful content; (e) attempts to gain unauthorized access to any part of the Site or its systems; or (f) interferes with the proper operation of the Site or the experience of other users.
9. Artwork & Creative Process
Bandley 3 embraces a range of creative methods. Our catalog includes:
Original Photography. Certain works in our collections are captured through traditional photography — composed, shot, and edited by our team or collaborating artists.
AI-Assisted Works. Some pieces in our catalog are created with the assistance of generative AI tools. These works begin with intentional, thoughtfully crafted creative direction and are further refined through manual editing, compositing, color grading, and post-production using professional design software. The human creative vision — from concept through final output — is central to every piece.
Digital Compositions. Other works are original digital compositions created using traditional design tools without AI generation.
Each product listing indicates the creative method used. Regardless of technique, every piece in our store meets the same standard of artistic intention, quality, and finish. We believe the value of art lies in the vision, curation, and emotional resonance it delivers — not solely in the tool used to create it.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BANDLEY 3, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bandley 3 and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the Site.
13. Third-Party Links & Services
The Site may contain links to third-party websites or services that are not owned or controlled by Bandley 3. We are not responsible for the content, privacy practices, or availability of any third-party sites. Your use of third-party sites is at your own risk and subject to their respective terms and policies.
14. Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising under these Terms that cannot be resolved informally shall be submitted to binding arbitration administered in San Francisco County, California, in accordance with the rules of the American Arbitration Association. You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
For consumers in the European Union: nothing in this section limits your rights under mandatory consumer protection laws of your country of residence, including your right to bring proceedings in your local courts.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Entire Agreement
These Terms, together with our Privacy Policy and Refund & Returns Policy, constitute the entire agreement between you and Bandley 3 with respect to your use of the Site and supersede all prior agreements and understandings.
